Blankenship; Suzy Palmer Subject: RE: 4/12 BOD Mtg I would like to devote the newsletter to correcting the notion that dues and assessments are not required and reinforcing the Close ruling that members cannot “opt out” of ACBC. Also---advise the members that a pool assessment ballot will be coming out in______?________ and to look for it. Remind them pursuant to the TRO there will not be an option to decommission the pool---- only options on how to fund its renovation. Blankenship; Suzy Palmer Subject: RE: 4/12 BOD Mtg Sorry on Treasurer - used last month as template The 5 members with refund checks not received will have to fill out forms and wait 90 days, then can be paid. I'll be contacting them today/tomorrow. Do you have a specific set of topics for a news letter at this point? I'd like to hold off on any discussion regarding collection beyond sending a "friendly reminder" type past due letter. Suggest dropping the <=50 from the chart since it includes all fully paid with a few not. (I'll be stopping by to drop off checks today which will in effect increase the number paid) I'm totally unsure about the lien situation, maybe some other Board members have some knowledge? Ed. Proposed change to 3rd Saturday … should be new business Also, add to new business: Mailing to all members – letter/newsletter ALL: For the discussion of Outstanding Dues & Assessments I plan to bring copies of the table below, comments follow: Balances as of 3/31/2014 Owed Lots Amount <= $50 422 ($404) <= $150 184 $23,512 <= $300 33 $8,423 <= $500 39 $16,223 <= $750 14 $9,025 <= $1000 7 $5,853 <= $1500 9 $11,096 1500+ 2 $4,713 Total 710 $78,441 How can we know whether we can lien properties legally? It’s rumored that we’ve had opinions on both sides of this issue. I believe Dustin was looking into our previous experience with a collection agency. I look forward to hearing how that worked out. What is the cost of having an attorney send out collection letters by certified mail? I’m thinking of a 3 step process: 1) We send out a balance due statement giving 30 days for payment prior to taking “appropriate action” on the account. 2) At 30 days, a letter from an attorney goes out, with threat of lien or collection agency, whatever we can legally do. 3) At 60 days, we follow through on the action If we started with just the 18 lots owing over $750, we would be addressing over 25% of the balances owed.
